Kardashian sisters’ Khroma Beauty debut make-up line has been forced to change its name to Kardashian Beauty in a trademark dispute.

WWD reports that the rebrand is being made to end an 8 month-long trademark dispute between the Kardashians and a Florida-based company called Kroma Makeup, which sought $10 million in damages.

An array of Khroma Beauty products had already been produced, promoted and were ready to hit more than 5,000 retailers across the U.S. but now the costly task of relabeling will begin.

Despite the announced changes, the Kardashian’s original website, www.khromabeauty.com, and Facebook page are still currently functioning.

The long-running saga started last June when Lee Tillett, the founder of Kroma Makeup, sent a cease-and-desist letter to Boldface Group Inc, the branding company behind the Kardashian’s Khroma Beauty line, accusing it of “stealing” the name.

Lee Tillett set up her company in 2004 and trademarked the name Kroma – which apparently means “color” in Greek – six years later.

In the legal case she sought $10 million in damages, claiming that the Kardashian sisters’ company, for which they are set to make at least $6.2 million, would cause confusion in the marketplace.

And it appeared that those leading the case agreed. After months of heavy promotion the Kardashians were instructed to stop distributing products this March.

“Tillett has demonstrated that [she] will likely lose business opportunities, customers and goodwill due to Boldface’s use of the confusingly similar Khroma Beauty marks,” Judge Audrey Collins, said in her ruling.

“The court has little doubt that, in short order, the Khroma Beauty products will likely eliminate Tillett’s business entirely, creating irreparable harm sufficient to justify an injunction.”

Boldface Group Inc appealed the decision, seeking to reverse the U.S. District Court’s injunction so Khroma Beauty products could go on sale, but this was not granted.

As a result Khroma Beauty has now officially changed its name to Kardashian Beauty.

Florida native, Lee Tillett, previously told the Orlando Sentinel: “I developed the Kroma line myself, built my business through my own hard work, and took the legal steps necessary to protect it.

“And yet I have now been forced into legal battle with the Kardashians simply because they have decided to take something that doesn’t belong to them.”

In her formal federal court response she claims the promotion of Khroma was likely to mislead customers into thinking her line is associated with the Kardashian sisters.

Lee Tillett added: “The false association is damaging … and threatens to destroy its business.”

According to the counter-claims, Boldface Group Inc had paid the Kardashians an upfront advance of $1 million for licensing rights, with guaranteed minimum royalty payments of $4.6 million to $5.2 million.

As part of the deal, they allegedly have some power over the product line and that Kim Kardashian “proposed” it be called Khroma.

Lee Tillett’s attorney Elliot Gipson claims Kim Kardashian should have known better.

He pointed to discussions by representatives for himself and TLK Fusion, which allegedly acted as Kardashian’s product-placement agent for a show that was being produced by Kim Kardashian.

Elliot Gipson said: “On or about May 2010, representatives for Tillett and TLK Fusion were engaged in discussions regarding the possible product placement of the KROMA cosmetics line on the television reality show special The SPINdustry that was scheduled to air on E! Entertainment Television following an episode of Keeping Up With the Kardashians.”

No deal was ever reached, but if this is true she could have had advance knowledge that the name was already in use.

Kim Kardashian said: “Am I the only one that is obsessed with her new makeover? I think she looks amazing. With the blonde hair and those nails?”

Khloe Kardashian also praised Amanda Bynes’ transformation, saying: “With all those extensions and makeup, you would think she looks hot. She does wear fishnets to the gym. I don’t think that’s abnormal. I love it.”

Amanda Bynes, who is a retired actress at 26, was grateful for the Kardashian sisters comments and later tweeted: “I love the beautiful Kardashian sisters!”

However, she admitted she was unhappy with the photos they used on the show.

Amanda Bynes added: “I wish E picked better photographs of me! I feel pregnant when I’m fat! I’m working out constantly!”

The troubled actress recently claimed she is suffering from an eating disorder and wants to weigh 100 pounds.

The Kardashian sisters could be left with an expensive legal bill after they were sued for allegedly stealing the name for Khroma Beauty, for which they are guaranteed to make up to $6.2 million.

Make-up artist Lee Tillett is seeking $10 million in damages from the sisters and Boldface Group Inc, which markets their line.

Lee Tillett claims it infringes on her Kroma Make-up line, which she founded back in 2004.

Florida native Lee Tillett told the Orlando Sentinel: “I developed the Kroma line myself, built my business through my own hard work, and took the legal steps necessary to protect it.

“And yet I have now been forced into legal battle with the Kardashians simply because they have decided to take something that doesn’t belong to them.”

It is the latest move in a legal tussle that began when she sent a cease and desist letter last July urging them to stop using the name.

In response Boldface petition a California federal court to get a judgement the name Kroma “consists solely of a descriptive term and lacks any inherent distinctive meaning to the relevant consuming public and therefore is conceptually weak”.

On the Kroma website it states the word means color in Greek, but adds how Lee Tillett used her 22 years (experience) of “creating looks for thousands of women” and “personally selected all of the shades and has personally made all of the formulas”.

And in her formal federal court response she claims the promotion of Khroma was likely to mislead customers into thinking her line is associated with the Kardashian sisters.

She added: “The false association is damaging … and threatens to destroy its business.”

According to the counter-claims, Boldface has paid the Kardashians an upfront advance of $1 million for licensing rights, with guaranteed minimum royalty payments of $4.6 million to $5.2 million, depending on launch dates of various products.

As part of the deal, they allegedly have some power over the product line and that Kim Kardashian “proposed” it be called Khroma.

Lee Tillett’s attorney Elliot Gipson claims the 32-year-old should have known better.

He pointed to discussions by representatives for himself and TLK Fusion, which allegedly acted as Kardashian’s product-placement agent for a show that was being produced by Kim.

No deal was ever reached, but if this is true she could have advance knowledge the name was already in use.

Kardashians spokesman Todd Wilson claims the sisters “have acted properly at all times”.

This is not the only lawsuit the product line is engulfed in at the moment.

Los Angeles-based Chroma Makeup Studio is also suing for alleged trademark infringement.

The Kardashian sisters have joined forces with UK high street staple Dorothy Perkins, just in time for the Christmas party season.

Kim, Kourtney and Khloe Kardashian have injected their va-va-voom style in to over 100 pieces for the store including sequined clutch bags, blinging tops and – of course – killer party dresses.

Kourtney Kardashian’s bohemian chic can be emulated with floaty drape sleeve blouses and Kim’s red carpet glamour arrives in “look at me” dresses while Khloé’s edgier dressing sees playful prints and a mix of textures.

Commenting on the partnership, a spokesman for Dorothy Perkins says: “This was an opportunity we couldn’t miss.

“This was an opportunity we couldn’t miss. Knowing how popular they are and the huge interest they attract, it enables our customer to buy in to their lifestyle and emulate their look at a great price.”

The Dorothy Perkins brand has been a feature of our high streets since 1919, and has previously been associated with more demure office and casual wear.

The store has recently re vamped its image though in the hope of attracting a younger, more glamorous crowd, and it doesn’t get more glamorous than the Kardashian sisters.

Kourtney, Khloe and Kim Kardashian are currently in the UK to celebrate the launch of the Kardashian Kollection (Khloe is jetting in especially after The X Factor in America). It is the first time that the girls have appeared together in London and they will be appearing at the Atrium at Westfield London on Saturday, November 10th, 2012, at 12:30 p.m.

Wristbands will be distributed from Westfield London from 9:00 a.m. and only the first 500 people to collect a numbered wristband will be eligible to enter the signing queue. As this is based on a first come first served basis, this does not guarantee that you will meet or obtain a signature from the Kardashian sisters, as there is a fixed time they will be at Westfield London to meet and greet their fans.

The Kardashian Kollection will be available in selected Dorothy Perkins stores and online from the 8th of November.

Kardashian sisters are on the hunt for a plus-size beauty to model their new denim line.

Kim, Khloe and Kourtney Kardashian, aged 31, 28, and 33 respectively, took to Khloe’s blog to announce the search which invites women over the age of 18 to send full-length photos of themselves to the famous sisters.

Kardashian Kurves, the new line, has been created in conjunction with Sears and will feature three styles, each inspired by one of the three sisters.

The chosen model will star in an advertisement for the line, which has not been given a release date as yet.

Khloe Kardashian outlined the contest’s grand prize, a round trip for one to Los Angeles to attend a photo shoot, on her blog.

She added: “It’s a venture we’re really thrilled about!”

The prize also includes one night’s accommodation in Los Angeles to ensure their model is in tip-top condition for the campaign’s photo shoot.

The line was originally announced through social media also – via Kim Kardaashian’s Twitter page.

The reality star posted: “Our Kardashian Kollection for Sears denim line is officially here!! There are three styles, each named after my sisters and me.”

Further images showed Kim Kardashian wearing her own version in the line.

She added on Twitter: “I’m wearing The Kim, which is a sexy, low cut, straight leg jean. Then Kourtney is wearing The Kourtney, a gorgeous skinny leg jean, and Khloe is wearing The Khloe, a tall curvy, high rise, boot cut!!”

Kim Kardashian continued to gush: “The jeans come in different washes so you can choose the fit and wash that’s perfect for you!”

“Nick Saglimbeni was the photographer and I love the way they turned out! Shoots with my sisters are the best!! Xo.”

All three sisters have posed in their first photos from the campaign, wearing their namesake trousers and identical button-down white shirts.

It is, of course, not their first collaboration with Sears.

They first launched the budget-friendly Kardashian Kollection for the chain store last August.

Unsurprisingly, Kim Kardashian did not look to her ex-sister in law, Kaela Humphries, to model the line.

The sister of Kris Humphries is a plus-size model herself and is signed to Ford modelling agency.

Interested fans need to submit an “essay” explaining what being “kurvy” and “konfident” means to them.

The deadline for entries is July 30.

Kourtney Kardashian and her fiancé Scott Disick welcomed a little girl into the world yesterday morning in Los Angeles.

And today, as they announced the news, they revealed that they had called her Penelope Scotland.

Kourtney Kardashian and Scott Disick already have a son, Mason, who is two.

Penelope Scotland was born at the Cedars-Sinai Medical Center and weighed seven pounds and 14 ounces.

Speaking to E! News, Kourney Kardashian said: “Scott and I are overjoyed to welcome our precious angel Penelope Scotland Disick into our lives.

“We are forever blessed. Mommy and baby are resting comfortably.”

According to Kourtney Kardashian’s mother Kris Jenner, her daughter had a natural birth and added: “It was a great. She had an easy delivery.

“[Penelope] is so cute. She looks just like Mason. She’s so beautiful. We are so happy.”

Two years ago, when Mason was born, Kourtney Kardashian and Scott Disick showed his birth on the family’s TV show, Keeping Up With The Kardashians.

But during an appearance on the Tonight Show a couple of weeks ago, Kourtney Kardashian said they hadn’t decided whether they would show Penelope’s.

She said: “We’re gonna film it again ourselves, and honestly, my experience last time was so peaceful and calm and everything you don’t see in the movies.

“And I really wanted to share that with people so they knew it doesn’t have to be a crazy screaming session.”

Back in May, Kourtney Kardashian’ sisters Kim and Khloe and all the family including Kanye West, threw a baby shower for her.

Kim Kardashian revealed in a recent interview with InStyle magazine that she loves being an auntie and is obsessed with Mason.
